These Terms & Conditions ("Terms") govern your use of BothConnect, a contact-introduction SMS service operated by Chacko Consulting ("we," "us," or "our"). By texting our service number, you agree to these Terms.

1. The Program

Program name: BothConnect.

Description: BothConnect is an SMS-based contact-introduction service. Users initiate a connection by texting our service number, provide basic information (first name, last name, email address), and supply the phone number of someone they would like to be connected with. The system delivers a one-time consent-based introduction SMS to that target number. Users may also send a selfie image via MMS for archival on their contact record.

2. Message and data rates

Message and data rates may apply. Carrier message and data rates apply to any messages sent to or received from BothConnect. BothConnect does not charge users for messages, but your wireless carrier may.

3. Message frequency

Message frequency varies by user activity. A typical onboarding flow involves 4–8 messages over a few minutes. Each connection request you initiate generates 1–2 additional messages. We do not send marketing or promotional messages.

4. Opt-in / Consent

By texting our service number, you provide express consent to receive replies and transactional SMS related to the connection flow you have initiated. Recipients of a connection request must reply YES before any further messages are sent to them; replying NO declines the introduction.

5. Opt-out instructions

STOP — Reply STOP to any BothConnect message to immediately unsubscribe. You will receive a single confirmation and will not receive further messages from BothConnect.

HELP — Reply HELP for support. You will receive an automated reply with contact information.

6. Support contact

For support, email [email protected] or reply HELP to any BothConnect message.

7. Acceptable use

You may use BothConnect only to request introductions with individuals you reasonably believe will welcome the introduction. You may not use the service to harass, threaten, impersonate, or spam any party. We reserve the right to suspend service to any user who appears to be misusing the platform, including senders who generate excessive opt-outs, abuse reports, or repeated rejected connection requests.

8. Privacy

Our handling of your information is described in our Privacy Policy. Of particular note: no mobile information (phone numbers, opt-in status, SMS message content, or any data shared with BothConnect via SMS) will be shared with third parties or affiliates for marketing or promotional purposes.

9. TCPA compliance

BothConnect operates under the U.S. Telephone Consumer Protection Act. We:

Send messages only between 8:00 AM and 9:00 PM in the recipient's local time.
Include opt-out language on every first outbound message.
Honor STOP replies immediately and permanently.
Throttle messages to no more than 3 outbound per recipient per 24-hour rolling window.
Block international numbers and inbound traffic from non-U.S. origins.

10. Service availability and limitations

BothConnect is provided "as is" and "as available." We do not guarantee delivery of any specific message — carrier-level filtering, network outages, and recipient device state can all prevent delivery. We rely on Twilio for SMS transport; service degradation upstream of BothConnect may affect availability.

11. Limitation of liability

To the maximum extent permitted by law, Chacko Consulting and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of BothConnect, including but not limited to lost opportunities, lost contacts, or carrier charges.

12. Termination

We may suspend or terminate your access to BothConnect at any time, with or without notice, if you violate these Terms or applicable law. You may terminate your participation at any time by texting STOP to the service number.

13. Changes to these Terms

We may update these Terms. The "Effective" date at the top reflects the latest version. Continued use after a change constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought in the state or federal courts located in Tarrant County, Texas.
